HC reprimands two magistrates for not admitting mistakes

The High Court has reprimanded two magistrates of Dhaka CMM Court for submitting inappropriate replies to the apex court’s queries about the reasons for frequently placing actress Pori Moni on remand in a case.

A division bench comprising Justice Mostafa Zaman Islam and Justice KM Zahid Sarwar Kajal expressed dismay at the replies of two magistrates on Wednesday.

On September 2, the HC had show-caused metropolitan magistrates Debabrata Biswas and Atiqul Islam for remanding Pori Moni on the second and the third occasions in a narcotics related case.  The HC put such queries to the magistrates, following a petition filed by the Ain o Salish Kendra (ASK) challenging the repeated remand of the actress.

In replies, the two magistrates said they placed Pori Moni on remand repeatedly considering the situation, but HC said such replies purportedly to ‘undermine’ the apex court. The two magistrates begged the HC’s pardon setting a condition. They tendered apology subject with the condition that their remand orders constituted any unintentional mistake.

Rejecting replies, the HC said the magistrates have defended their remand orders and tried to reinforce that they did not commit any mistake.

The HC has fixed Sept 29 for next hearing on the writ petition. The two magistrates have been directed to submit further replies on the issue of Pori Moni’s repeated remand by that time.  Investigation Officer of the case Golam Mostafa will have to appear before the High Court on the day of next hearing, being equipped with documents substantiating reasons for seeking repeated remand of the actress.
