Petition seeking cancellation of charge-framing dropped from cause list

The High Court on Monday dropped from its cause list a petition seeking the cancellation of charge-framing against four accused in a case for the killing of Mymensingh Girls' Cadet College student Sharmila Shaharin Pollen.

An HC bench comprising Justice M Enayetur Rahim and Justice Amir Hossain passed the order.

Before passing the order, the court observed that the court is not willing to interfere and issue a rule at the current stage of the trial, though the defence can move to the Appellate Division in this connection if they want to.

Advocate Yusuf Hossain Humayun stood for the defence during the hearing.

Earlier on Sunday, the court heard arguments of both the state and the defence an fixed today (Monday) for their judgment on the petition.

Four of the five accused, including Nazmul Haque, are on bail while another accused, Monir Ahmed Chowdhury, remained absconding.

On February 11, 2005, police recovered the body of Sharmila Shaharin Pollen, 18, a second year student of the college and daughter of Abul Bashar Patwary, from her dormitory.

On February 19, victim’s father Patwary filed a case against some unidentified people with Mymensingh District and Judge Court in this connection.

On March 3, 2016, a Mymensingh court framed charges against five peoplefor their alleged involvement in the killing, following a judicial probe report submitted by magistrate Al-Amin.

Later, four of the accused filed a petition with the High Court seeking cancellation of the charge-framing.
