Narcotics case against Pori Moni: HC questions legality of lower court’s delay in settling bail petition

The High Court has questioned legality of the lower court’s delay in settling bail petition filed by film actress Pori Moni in a narcotics case.

However, the HC rejected bail petition filed by Pori Moni in the case,

A division bench of Justice Mustafa Zaman Islam and Justice KM Zahid Sarwar Kajol passed the order on Thursday, following a criminal revision petition filed by Pori Moni, challenging the lower court order which fixed a remote date for hearing bail plea.

Rapid Action Battalion (RAB), on August 4, raided Pori Moni’s Banani home and detained her with huge liquor, yaba pills and LSD blotting papers. The following day, she was produced before the lower court and sent to jail.

On August 19, the lower court rejected Pori Moni’s bail petition.

Judge KM Emrul Kayesh of Metropolitan Sessions Judge's Court set September 13 for hearing the bail petition instead of settling it.

Pori Moni, on August 26, filed the petition challenging the Metropolitan Sessions Judge's Court decision through her lawyer.

Though the HC did not grant Pori Moni bail, it questioned legality of the Sessions Judge’s order.

The apex court issued a rule asking the state to clarify why the lower court's order fixing September 13 for hearing bail petition of Pori instead of settling it shall not be declared illegal.

The court set September 1 for hearing of the rule.

Human rights lawyer ZI Khan Panna along with Mozibur Rahman appeared for Pori Moni. Assistant Attorney General Md Mizanur Rahman stood for the state.
