Babul Chisty, his entire family involved in criminal offence: SC

The Supreme Court on Thursday observed that former Chairman of Farmers Bank’s Audit Committee Mahbubul Haque Chisty alias Babul Chisty and his entire family have been involved in criminal offence.

The court said it was seen from the case documents that Babul Chisty is the prime offender. He used all the members of his family in criminal activities.

Justice Muhammad Imman Ali of the Appellate Division came up with the observation while hearing a bail petition submitted by Babul Chisty’s son Rashedul Haque Chisty alias Rashed Chisty.

“You still could not prove what the legal sources of his money are,” the court said pointing to Rashed’s lawyer AF Hasan Ariff.

ACC lawyer Khurshid Alam Khan opposed the bail pleas, saying the accused has not refunded even a single Taka to the state coffer.

He said the court made some observations during the hearing on the bail petition and asked for submitting some documents during the next hearing on Tuesday.

On January 26, the HC upheld a lower court order that granted bail to Rashed Chisty in a case filed on charges of laundering Tk 159 crore.

Later on February 1, the Appellate Division stayed the HC order after the ACC filed a petition challenging the bail order. The court also asked for submitting a leave-to-appeal petition.

On May 19 last year, a trial court granted bail to Rashed Chisty in several cases. Later, the ACC submitted a petition with the HC seeking stay on the bail.

The Anti-Corruption Commission (ACC) filed a case with Gulshan Police Station against six people, including Babul Chisty, his wife Rozi Chisty and their son Rashed Chisty, Farmers Bank’s First President Muhammad Masudur Rahman Khan, Senior Vice-president Ziauddin Ahmed and former Gulshan branch Manager Delwar Hossain.

The case was filed on charges of embezzling Tk 159.95 crore. Babul Chisty and his son Rashed Chisty are behind the bars since their arrest in the case.

In 2019, another case was filed against Babul Chisty on charges of amassing illegal wealth worth Tk 37.38 crore and money laundering.

A Dhaka court ordered the authorities to freeze and confiscate Babul Chisty’s moveable and immoveable property following a petition submitted by the investigation officer of the case.

The seized immovable property of Babul Chisty included 49 decimals of land, 34 decimals, 36 decimals, 3,000 square feet, 73 decimals, 15 decimals, 7.50 decimals, eight decimals, 28 decimals, 58 decimals, 24 decimals, 24 decimals, one tin-shed house, 300 decimals, 33 decimals, 10 decimals, 12.50 decimals, eight decimals, 28 decimals, two decimals, 10 decimals, 138 decimals, 46 decimals, 72 decimals, 25 decimals, 18 decimals, 12.50 decimals, 33 decimals, 14 decimals, 22 decimals, a three-storey building,  two tin-shed buildings, 40 decimals, 111 decimals, 110 decimals, 25 decimals, 30 decimals, 11.15 decimals, 222.50 decimals, 55 decimals, 36 decimals, 91 decimals, 26 decimals, 39 decimals and 37 decimals of land in different mouzas of Bakshiganj in Jamalpur and 200 decimals of land at Madabpur mouza of Sreebardi in Sherpur.

Apart from this, a jeep, two private cars and two motorcycles were also seized. The movable wealth is one shotgun, one pistol and an oil tanker worth Tk 20.11 crore.

The court also seized the deposited money in 28 bank accounts in Farmers Bank, Padma Bank, AB Bank, Islami Bank Bangladesh Ltd, Janata Bank, Jamuna Bank, Bank Asia and National Bank.

Shares worth Tk 2 crore of Padma Bank, 5,000 shares of CN News Limited,  6,500 shares of currentnews.com.bd, 1,200 shares of MM Z IT Source and Service Ltd, 20,000 shares of Channel 26 Ltd, 500 shares of Fusion Footwear Ltd, one share of Padma Bank Securities Ltd and 500 shares of Babul Chisty Steel Mills Ltd.

On January 23, a case was filed against Babul Chisty’s wife Rozi Chisty on charges of amassing illegal wealth worth Tk 37.38 crore and money laundering.

Rozi Chisty’s immovable wealth included a seven-storey building on a plot at Mirpur Housing Estate under Kakoli mouza in the capital’s Mirpur area, 15 decimals of land in Uttarkhan, 79 decimals and 55 decimals in Char Kawria mouza in Bakshiganj in Jamalpur, four flats in Mymensingh town and a three-storey building on 3 kathas of land in Jowarsahara mouza.

Apart from this, she owned a seven-storey building on five decimals of land and an under-construction building on a 14 decimals of land in Sadar Town mouza in Mymensingh.

She also possessed 7.50 decimals of land in Boro Nawra mouza in Narayanganj, 266 decimals in Madabpur mouza in Sreebardi’s Jangla in Sherpur.

Rozi Chisty also owned 59.5 decimals of land, 39 decimals, 100 decimals, 100 decimals, 20 decimals, 85 decimals, 15 decimals, 53 decimals, 80 decimals, 34 decimals, 15 decimals, 67 decimals, 110 decimals, 138 decimals, 55 decimals, 62 decimals,14.5 decimals, 55 decimals, four decimals, 12.60 decimals, 62.75 decimals, 72 decimals, 61.77 decimals, 2.7 decimals, 52 decimals, 20.50 decimals, 24.25 decimals, 4.5 decimals, 54.26 decimals, 34 decimals, 34.50 decimals, 102 decimals, 62.75 decimals, 15 decimals, 24.50 decimals, 11 decimals, 12 decimals and 31 decimals of land at different mouzas in Bakshiganj of Jamalpur.

A car of Toyota Noah model and another Tata tanker model car were also seized.

Of the movable wealth, the court froze five bank accounts in Farmers Bank, one each in Bank Asia and Trust Bank. It also ordered to freeze 1,250 shares of Ruposhi Land Developer Limited, 30 per cent shares of Bakshiganj Agro Industries, 500 shares of Fusion Footwear, 40,000 shares of Bakshiganj Jute Spinners Ltd and savings certificates worth Tk 3.50 lakh.

The court seized immobile wealth of Rashed Chisty. The wealth included semi-paka house on four decimals of land at Tejgaon in Dhaka, seven decimals of land in Bashundhara, 4.50 decimals and 3 kathas of land in Singair in Manijkganj, a flat in Mymensingh town and another flat in Chattogram.

Of the movable property of Rashed, the money of 22 accounts in different banks, 30 lakh shares of Padma Bank, 3,000 shares of CN News Ltd, 4,500 shares of currentnews.com.bd, 1,250 shares of Ruposhi Land and Developers Ltd, 70 per cent shares of Bakshiganj Agro Industries Ltd, one share of Padma Bank and Padma Bank Securities Ltd, 19,500 shares of Babul Chisty Steel Mills Ltd and shares of Bakshiganj Jute Spinners Ltd worth Tk 9 crore were also seized.

A case was also filed against Babul Chisty’s daughter Rimi Chisty on December 15, 2019 on charges of amassing illegal wealth worth Tk 21.20 crore and money laundering.

The court seized 40 decimals of land, 4.676 decimals, 11.50 decimals, 25 decimals of land in different mouzas of Jamalpur and 20 decimals in Gazipur.

Around Tk 21 lakh at six bank accounts of Farmers Bank and one in Trust Bank owned by Rimi Chisty and 10,000 shares of Bakshiganj Spinners Ltd were also frozen.

On December 15, 2019, another case was filed against Rahsed Chisty’s wife Farhana Ahmed on charges of amassing illegal wealth worth Tk 13.68 crore and money laundering.

The court seized one motor car and three bank accounts of Farmers Bank and four of Jamuna Bank where she deposited Tk 15 lakh.

On December 5, 2019, a case was filed against Babul Chisty’s brother-in-law Md Mostafa Kamal on charges of amassing illegal wealth worth Tk 84.72 lakh and money laundering.

The court seized a flat under Meradia mouza of Rampura area in the capital, three decimals of land in Mymensingh Sadar, 15 decimals in Danua Kamalapur, 100 decimals, 15.62 decimals, 17.50 decimals, 15.62 decimals, 17.50 decimals and 58 decimals of land and a Toyota car of Mostafa Kamal.

Apart from this, Tk 15 lakh in 13 bank accounts of Farmers Bank while 3,300 shares of Farib Auto Rice Mill Ltd were also seized.
