SC summons former primary DG, four others in a contempt proceeding

The Appellate Division of the Supreme Court has summoned former primary DG and now defence secretary Abu Hena Mostafa Kamal and four others for violating its previous order.     

Four others are-- deputy director of DPE Md Ramjan Ali, Gaibandha district primary education officer Aminul Islam, Gaibandha Sadar upazila primary education officer Md Abdus Salam and Gaibandha Sadar upazila assistant education officer Masumul Islam.

They have been asked to appear before the court on December 14 with explanation for failing to comply with the order.

A three member bench led by Senior Justice of the Appellate Division Mohammad Iman Ali passed the order on Monday.  

According to the case, one Beauty Begum of Gaibandha Sadar Upazila stood first in the teachers’ recruitment test in a non-government registered primary schools in 2008. Instead of appointing her, the school authorities appointed second position scorer Nazma Sultana. In course of time, the government has nationalised the school.

 Being deprived of the job, Beauty filed a case with Gaibandha Assistant Judge Court and got a favourable order. The matter came to the High Court and Appellate Division of the Supreme Court which passed order favouring Beauty and directing the authorities concerned to appoint her for the post.

For not complying with the order, the SC issued contempt of rule against then primary DG and four others in March this year. The above officials were asked to submit reply to the contempt rule during a period from March 2 to 16. Instead of replying, the above officials prayed for extension of time.

Barrister ABM Alataf Hossain appeared for the petitioner while lawyer Shafique Mahmud for the state.
