The High Court has summoned chairman of the Bangladesh Food Safety Authority (BFSA) for failing to withdraw 52 substandard products from markets.
The court issued a rule asking why BFSA chairman Mohammad Mahfuzul Hoque shall not be punished for contempt of court. The BSFA chairman will have to appear before the High Court on June 16 to explain his failure to withdraw the substandard products.
A division bench comprising Justice Sheikh Hassan Arif and Justice Razik-Al-Jalil passed the order on Thursday.
The High Court heavily came down upon the Bangladesh Food Safety Authority for not withdrawing a single substandard product so far.
Bangladesh Food Safety Authority was lambasted for not utilising its 17- member manpower in Eskaton office by launching a drive in a nearby market.
The BFSA and the Directorate of National Consumer Rights Protection submitted compliance reports to the HC through their lawyers, Faridul Islam and Kamruzzaman Kachi, on Thursday.
Expressing dissatisfaction with a compliance report submitted by the BFSA, the court questioned justification of an organisation like it if it cannot function properly. The chairman of BFSA cannot go unpunished, the court observed.
The High Court wanted to know whether the BSFA chairman is afraid of the harm that might be caused by the businessmen if he withdraws the banned products from the market.
The BSFA chairman and his staffs may give up the challenging job and join any bank to count money which has no professional hazard, the court said.
However, the HC appreciated frequent drives against adulterated foods conducted by the Directorate of National Consumer Rights Protection.
On May 12, the HC banned production and sale of 52 substandard food products found to be injurious to human health.
Conscious Consumers Society (CCS), an organisation working to protect consumers’ rights, filed a writ with the HC on May 9 seeking its order to ban substandard food items
The petitioner annexed a newspaper report published on May 2 with headline “Popular products of 52 companies found substandard.”
The report was based on the findings of BSTI which conducted test on food samples and found 52 items spurious.
BSTI came up with list of the products at a press conference in the capital on May 3 after testing the consumer products ahead of Ramadan.
Salts of ACI and Molla brands and edible oil of Teer, Rupchanda, and Pusti were found to be substandard by BSTI.
Bangladesh Standards and Testing Institution (BSTI), Bangladesh Food Safety Authority (BFSA) and the Directorate of National Consumer Rights Protection will have to execute the order.
