The Appellate Division on Wednesday cleared the way for BNP lawmaker Sarwar Alamgir to continue serving as a member of parliament after removing from its cause list a petition seeking to bar him from discharging his duties as the MP for Chattogram-2.
Following the order, Attorney General Barrister Md Ruhul Quddus Kajal said there was no legal obstacle to Sarwar Alamgir continuing to perform his responsibilities as an MP.
The order was passed by the Appellate Division headed by Chief Justice Zubayer Rahman Chowdhury.
The apex court also asked the petitioner to file a regular appeal against the High Court verdict that had declared Sarwar Alamgir's candidacy for the 13th parliamentary election in Chattogram-2 valid.
The Attorney General represented the state during the hearing. Barrister Mahbub Uddin Khokon and Advocate Ahsanul Karim appeared for the BNP lawmaker, while Advocate Mohammad Shishir Monir represented the Jamaat-e-Islami candidate.
On Tuesday, the Appellate Division had fixed Wednesday for delivering its order on the petition seeking a stay on the High Court judgment validating Sarwar Alamgir's candidacy.
Earlier, after the High Court upheld his candidacy, Sarwar Alamgir, who was elected from the Chattogram-2 constituency in the 13th parliamentary election, was sworn in as a member of parliament.
