Remove illegal structures from Hatirjheel: HC

The High Court on Monday ordered the authorities concerned for demolition of all unplanned structures from the Hatirjheel-Begunbari project which were built beyond its layout plan.

A division bench comprising Justice Md Nazrul Islam Talukder and Justice KM Hafizul Alam passed the order following a public interest litigation (PIL).

Human Rights and Peace for Bangladesh (HRPB) filed the PIL with the High Court after a newspaper report published in this regard on August 1.

The HC issued a rule asking the authorities concerned to explain as to why they shall not be directed to halt construction of any structure not enumerated in the Hatirjheel-Begunbari Project layout and protect the project area.

Public works secretary, Dhaka South City Corporation (DSCC) chief executive officer, RAJUK chairman, DMP commissioner, Hatirjheel police station officer-in-charge (OC) and concerned project director will have to reply to rule within four weeks.

Shortly after start of beautification process in Hatirjheel-Begunbari area, different illegal restaurants and other businesses got a mushroom growth, the petitioner said, quoting the newspaper report.

Although these illegal structures were built in the open view of the public, RAJUK did not take any action against it.

The HC has also instructed the RAJUK chairman, DMP commissioner, Hatirjheel OC and the project director to keep the area under regular supervision to prevent construction of any illegal structure in future.

The officials concerned will have to submit compliance and progress report within two weeks.

Supreme Court lawyer Manzill Murshid, also president of HRPB, appeared for the petitioner while deputy attorney general Amit Talukdar appeared for the state.
