Khaleda serves legal notice upon govt

BNP Chairperson Khaleda Zia on Wednesday served a legal notice to the government requesting it to let the Special Judge Court No. 8, Dhaka proceed with the trial of a case filed against her at its previous place of sitting in Bakshi Bazar in the capital instead of the old Dhaka Central Jail.

On behalf of former prime minister Khaleda Zia, her lawyer Muhammad Nawshad Zamir, also international affairs secretary of the BNP, served the legal notice to the secretary of the ministry of law, justice and parliamentary affairs by registered mail.

The notice said that the government has issued a special order publishing gazette notification to transfer the place of sitting of the Special Judge Court No. 8, Dhaka to Room No. 07 in the administrative building of old Dhaka Central Jail for the trial of Special Case No. 18/2017.

It said, “The special order declaring a particular room in the old Dhaka Central Jail is absolutely illegal and without jurisdiction and lawful authority as being totally unwarranted by law.”

The special order is void as being passed illegally and without lawful authority, infringing Article 35(3) of the Constitution of Bangladesh that guarantees every person accused of a criminal offence the inalienable fundamental right “to a speedy and public trial”.
