Supreme Court allows govt to move against HC order on mobile court operation

The Supreme Court has allowed the government to move three appeals against High Court order that declared illegal the operation of mobile court by the executive magistrate, UNB reports.

A five-member bench of the Appellate Division headed by acting Chief Justice Md Abdul Wahhab Miah passed the order granting the leave to appeal petitions filed by the government on Tuesday.

The SC also fixed February 13 for next hearing.

Executive magistrates can conduct mobile courts until disposal of the appeals, said Attorney General Mahbubey Alam.

Earlier on January 9, the SC came up with an order that the operation of mobile court by the executive magistrate would continue until disposal of three appeals filed by the government against the HC verdict over the mobile court act.

On May 11, the High Court declared illegal of the operation of mobile court by the executive magistrate and later on May 14, after hearing on a government appeal, the chamber judge stayed until May 18.

Later, the SC extended the time for several times.
