The appellate division of the Supreme Court has upheld the chamber Judges Court verdict that halted the HC order that stayed two circulars of BTRC inviting applications for auction of 4G spectrum for the telecommunication industry.
A five-member bench of the Appellate Division headed by acting chief justice Md Abdul Wahhab Miah, passed the order after disposing of a petition filed by BTRC seeking a stay on the HC order.
Earlier, Chamber Judge of the Appellate Division of the Supreme Court Syed Mahmud Hossain halted an order of the High Court that stayed two circulars of BTRC inviting applications for auction of 4G spectrum for the telecommunication industry on Saturday.
The High Court earlier stayed execution of two circulars issued by the BTRC inviting applications for the auction of 4G spectrum for the telecommunication industry.
A division bench comprising Justice Naima Haider and Justice Zafar Ahmed came up with the order based on a writ petition filed by wireless internet provider Bangla Lion Communications Ltd.
The HC issued a rule asking the authorities concerned to clarify as to why the impugned circulars shall not be declared illegal.
The petitioner contended that BTRC issued the circular in utter disregard to clauses 4.2 and 4.06(3) of broadband wireless guideline of 2008.
